Terms of Service
Last updated: October 27, 2026
These terms are the contract between you and us for a ViralSwap subscription. The EULA covers the Mac app itself and the Refund & Cancellation Policy covers canceling, refunds and the right of withdrawal; both are part of these terms. The Privacy Policy explains what we do with personal data.
Key points
- ViralSwap is a Mac app. It makes videos on your Mac, with your own Higgsfield credits and your own Claude plan. Those companies bill you, not us.
- You pay us through Whop. Your subscription renews automatically until you cancel, and you can cancel at any time.
- Changed your mind? Ask within 14 days of your first payment and you get it back.
- Each subscription runs on one Mac at a time. Beginner makes up to 20 videos a day and Pro up to 100; Ultra has no daily limit.
- You may only create characters of yourself, of an adult who gave you written permission, or of an AI-made person.
- You're responsible for the reels you recreate and for the videos you post.
These points are a summary. The sections below are what count.
1. Who we are
ViralSwap is sold by Vincent Dottai, who runs a sole proprietorship registered in Poland's business register (CEIDG) as Vincent Dottai Marketing JDG ("we", "us").
- Address: Ostrzycka 1/3, 82, 04-035 Warszawa, Poland
- Tax ID (NIP): 1133213907
- E-mail: support@viralswap.io
- Phone: +48 508 850 327
2. What ViralSwap is
ViralSwap is a Mac app that recreates short videos ("reels") with an AI character you create. You add reels, the app checks each one, and for the reels you start it makes a new video with your character. To do this it uses your own accounts with other companies (section 4).
The work happens on your Mac and on those accounts. What we provide is the app and its updates, our instructions for the AI models it uses, and the license server that checks your subscription.
Results made with AI vary. The app checks each reel before it spends credits and tells you why a reel was skipped or failed, but we can't promise that every reel can be recreated, that a video will look exactly like the original or like your character, or that any video will get views, followers or income.
3. Who can buy and use ViralSwap
- You must be at least 18 and able to enter into a binding contract.
- If you buy for a company or another organization, you confirm that you may accept these terms for it. "You" then means that organization.
- You may not buy or use ViralSwap where sanctions of the EU, the UN, the UK or the US forbid it.
You're a consumer if you buy ViralSwap mainly for purposes outside your trade, business, craft or profession. Some sections give consumers extra rights. If you're a consumer, these terms never take away rights that the law of the country where you live gives you and that a contract can't exclude.
If you run a sole proprietorship in Poland and ViralSwap isn't of a professional nature for you (judged mainly by the business activities listed in your CEIDG entry), Polish law also gives you the consumer rules on unfair terms, the right of withdrawal and the conformity of digital content.
4. What you need, and your accounts with other companies
To use ViralSwap you need:
- a Mac with Apple silicon (M1 or newer), macOS 14 or later, and an internet connection;
- a Higgsfield account with enough credits: Higgsfield trains your character and makes the videos;
- a Claude account from Anthropic with a paid plan such as Claude Pro or Max, or an Anthropic API key: Claude plans each video and describes your character;
- optionally, a HikerAPI key, if you want to paste Instagram links or @handles instead of adding video files.
Your accounts with Higgsfield, Anthropic and HikerAPI are your own contracts with those companies. They bill you directly, and their terms, usage policies and privacy policies apply to what you do through them. We don't resell or pay for their services, and we can't refund their charges.
- Credits. Higgsfield sets its prices and decides which of its plans cover what the app does. Before a new character or a batch of videos starts, the app can show the credits it expects to use, but the amount Higgsfield charges is what counts.
- Usage limits. Claude plans have usage limits, which can slow down large batches.
- Setup. During setup, the app installs Claude Code with Anthropic's own installer and downloads the speech and face models it needs.
- Changes by these companies. These companies may change or stop their services, prices or terms. If such a change means ViralSwap can no longer provide a main feature, section 14 applies.
5. Plans, prices and payment
- Beginner: up to 20 videos a day. $29 every 30 days, $59 every 90 days, or $179 every 365 days.
- Pro: up to 100 videos a day. $49 every 30 days, $99 every 90 days, or $299 every 365 days.
- Ultra: no daily video limit. $79 every 30 days, $179 every 90 days, or $499 every 365 days.
Both plans include everything else, such as creating characters and free edits (captions, sound sync, trims), on one Mac at a time (section 6).
- Tax. Prices are in US dollars and don't include tax. Whop adds sales tax or VAT at checkout where it applies, based on where you are, and shows the total before you pay. The price shown at checkout is the price you pay.
- No trial. There is no free trial.
- Payment through Whop. Whop runs the checkout and takes payments for us as our payment processor. Whop's Buyer Terms apply to the payment itself. Your card or bank statement shows WHOP*VIRALSWAP. We never see your full card details.
- Renewal. Your subscription renews automatically at the end of each period (every 30, 90 or 365 days, depending on the price you chose), and Whop charges your payment method again, until you cancel.
- Failed payments. If a renewal payment fails, Whop tries again for a while and ViralSwap keeps working meanwhile. If the payment still doesn't go through, your subscription ends.
- Price changes. We may change our prices. A new price applies to your subscription only from the first renewal that is at least 30 days after we've told you about it by e-mail. If you don't want to pay the new price, cancel before that renewal.
- Changing plans. Each purchase is its own subscription. To move to a bigger plan (for example from Pro to Ultra), buy it and cancel the old one; the old one keeps running until the end of the period you've paid for. If you have more than one subscription, each one runs on its own Mac.
6. One Mac, the daily limit and license checks
- One Mac at a time. Each subscription runs on one Mac at a time: the first Mac you sign in on. To use ViralSwap on another Mac, sign in there with Whop and click Move ViralSwap to this Mac. The old Mac is signed out at its next check. You can move a subscription 3 times in any 30 days.
- Daily limits. Beginner makes up to 20 videos a day and Pro up to 100. A video counts once, when you press Start, on your Mac's calendar day. Making a video again counts as a new video. Checking reels before you start is free and never counts.
- License checks. The app checks your subscription with our server about every hour and when you start videos. Without a connection, it keeps working for up to 3 days.
- When a subscription ends, the app locks at its next check. Your files stay on your Mac: the videos you saved stay in your Movies folder, and the rest stays in the app's data folder until you delete it.
7. The app
The ViralSwap app is licensed to you, not sold. What you may and may not do with it is set out in the EULA.
8. Canceling
You can cancel at any time: in the app under Settings › Plan › Manage subscription, or in your orders on whop.com. To avoid the next charge, cancel before your renewal date.
After you cancel, ViralSwap keeps working until the end of the period you've paid for, and you won't be charged again. Until that date you can take the cancellation back on Whop. Payments for the current period aren't refunded, except as the Refund & Cancellation Policy or the law provides.
9. Right of withdrawal for consumers in the EU, the EEA and the UK
If you're a consumer living in the EU, the EEA or the UK, you may withdraw from your contract within 14 days of buying, without giving a reason, even if you've already started using ViralSwap. We don't ask you to give up this right. The Refund & Cancellation Policy explains how to withdraw and has a model withdrawal form. Every customer can also get their first payment back within 14 days under our money-back promise in that policy.
10. Characters
A character is the AI version of a person that ViralSwap puts into your videos. You may create a character only of:
- yourself;
- another adult who gave you written permission to create an AI character of them and to use it in the videos you make and post; or
- an AI-made person, who isn't a real person and isn't made to look like a particular real person.
For every character:
- Adults only. The person must be at least 18, and an AI-made person must clearly be an adult. The app refuses photos of anyone who may be under 18 and deletes them.
- Your confirmation is recorded. When you create a character, the app asks who the person is and stores your answer, your confirmation and the time with the character on your Mac.
- Keep the permission. If the character is someone else, keep their written permission for as long as you use the character or any video with it is online, and show it to us if we ask, for example after a complaint.
- If permission is withdrawn, stop making videos with the character, delete it, and take down videos where the law or the permission requires it.
- Photos. You must have the right to use the photos you add, including the photographer's rights.
The app's checks help, but they can't tell for certain who a photo shows, how old someone is or whether you have permission. You're responsible for the characters you create.
11. The reels you recreate and the videos you post
You choose the reels you recreate and decide what to do with the videos, so you're responsible for them.
- Other people's rights. A recreated video can contain much of someone else's work: the original's idea, script, words, performance and look, its sound (including the original creator's voice and any music) and its captions. Make sure you have the rights or permission you need for the reels you add and for the videos you make and post, or that a legal exception clearly covers what you do. We don't give you any rights in other people's work.
- The original creator. Don't present a video in a way that makes people believe that the original creator or anyone else made it, appears in it or endorses it, or that it is the original.
- Platform rules. Follow the rules of the platforms where you post, such as Instagram, TikTok and YouTube, including their rules on originality, reposting, impersonation and AI-made content.
- Labeling AI content. Mark videos as AI-generated or altered wherever the law or a platform requires it. In the EU, for example, the AI Act requires deepfakes to be disclosed.
- Downloads. If you paste links or @handles, the app downloads the reels on your Mac through your own HikerAPI key. You're responsible for using HikerAPI and the downloaded reels in line with HikerAPI's terms, the platform's terms and the law.
- Complaints about your videos. If someone complains to you about one of your videos, deal with it, and take the video down if the complaint is justified.
12. What you must not do
Don't use ViralSwap to make content that:
- shows a real person nude or in a sexual way, or shows or sexualizes anyone under 18 (also as an AI-made person);
- shows a real person without the permission section 10 requires, or impersonates someone to mislead, defraud or harass;
- is illegal, defamatory, hateful, threatening or harassing, or deceives people about elections, public health, emergencies or other matters of public interest;
- infringes anyone's copyright, trademarks or privacy, or their rights in their image, voice or name; or
- breaks the terms or usage policies of Higgsfield, Anthropic, HikerAPI or the platforms where you post.
And don't:
- share your subscription with people outside your own business, resell it, or get around the one-Mac rule, the daily limit or the license checks;
- copy, extract, publish or reuse our instructions, prompts or rules for the AI models, for example to build a competing product;
- copy, modify or reverse-engineer the app, except as the EULA or the law allows; or
- disrupt or overload our server, or try to access data that isn't yours.
If you're an agency, you may make videos for your clients. Your clients may not use your subscription themselves.
13. What's yours and what's ours
- Yours. We don't own the reels, photos and other material you add, or the videos you make, and we don't receive them: they stay on your Mac and with the services you use. Which rights you have in a video depends on the rights in the original, on the law and on the terms of the services that made it. We don't promise that a video is free of other people's rights or protected by copyright.
- Ours. The app, our instructions, prompts and rules for the AI models, our website, and the ViralSwap name and logo belong to us or our licensors. You only get the rights that these terms and the EULA give you.
- Feedback. If you send us ideas or suggestions, we may use them freely.
14. Support, updates and changes to ViralSwap
- Support. Write to support@viralswap.io.
- Updates. During your subscription we provide the updates needed to keep ViralSwap working as these terms describe and to keep it secure. Install them when the app offers them: an old version may stop working with our server or with the other companies' tools. If you're a consumer and don't install an update we told you about, we're not responsible for a problem that the update would have fixed.
- Availability. Our server may sometimes be unavailable, for maintenance or because of problems we can't control. The app keeps working for up to 3 days without it.
- Changes to ViralSwap. We may change ViralSwap for good reasons: to adapt to changes at Higgsfield, Anthropic, HikerAPI, Whop, in macOS or in the law, for security, or to improve, add or replace features. Changes cost you nothing extra. If a change makes ViralSwap clearly worse for you, for example because it takes away a main feature, we tell you by e-mail beforehand, and you may end your subscription within 30 days of the change and get back the part of your last payment that covers the time after it.
- If we stop offering ViralSwap, we tell you at least 60 days beforehand and refund the part of your last payment that covers the time after the end.
15. If ViralSwap doesn't work as it should
If you're a consumer, the law gives you rights if ViralSwap doesn't match these terms (the legal guarantee of conformity for digital content). Tell us at support@viralswap.io what's wrong, and we'll fix it within a reasonable time and at no cost to you. If we can't or don't, you may ask for a price reduction or, unless the problem is minor, end your contract and get back what you paid for the time ViralSwap didn't work properly. These rights apply whatever else these terms say.
If you're a business customer, ViralSwap is provided "as is" and, as far as the law allows, we give no warranties other than those in these terms.
16. Our liability
- Nothing limits our liability for damage we cause intentionally or through gross negligence, for death or personal injury, for fraud, or any other liability that the law doesn't allow us to limit.
- Consumers. If you're a consumer, we're liable under the law for damage we cause by breaking these terms.
- What we're not responsible for, unless we caused it by breaking these terms: the services, charges and decisions of Higgsfield, Anthropic, HikerAPI, Whop and the platforms where you post; what you create and post and what follows from it, such as claims by others, takedowns or account bans; and results that aren't what you hoped for where ViralSwap worked as described.
- Business customers. We're not liable for lost profits, revenue, business, goodwill or data, or for indirect or consequential damage. Our total liability for all claims is limited to the amount you paid us for ViralSwap in the 12 months before the event that led to the claim.
- Keep copies of the videos and files that matter to you.
17. Claims against us because of your content
If you're a business customer, you'll compensate us for the costs, damages and reasonable legal fees we incur because someone else makes a claim that arises from your characters, the reels you recreate or the videos you make or post, or from your breach of sections 10 to 12. We'll tell you about such a claim promptly and let you take part in the defense.
18. Suspending or ending your subscription
We may suspend ViralSwap for you or end your subscription if you seriously or repeatedly break these terms (for example sections 10 to 12), or if the law or an authority requires it. Unless that's unlawful or would let serious harm continue, we first tell you what's wrong and give you a chance to fix it. If we end your subscription because you broke these terms, you won't get a refund, except where the law requires one. If we end it for any other reason, we refund the part of your last payment that covers the time after the end.
19. Complaints
Send complaints to support@viralswap.io or by post to our address in section 1. Tell us what happened and what you'd like us to do. We reply within 14 days.
If you're a consumer, you can also get free help and advice: in Poland from your local consumer ombudsman (rzecznik konsumentów) or the Trade Inspection (Inspekcja Handlowa), see uokik.gov.pl; in the rest of the EU, in Norway and in Iceland from the European Consumer Centre of your country. We aren't obliged to use out-of-court dispute resolution, but if a complaint doesn't settle the matter, tell us if you'd like to try it, and we'll tell you whether we agree.
20. Law and courts
These terms, and every contract made under them, are governed by Polish law. The UN Convention on Contracts for the International Sale of Goods doesn't apply.
- Consumers: this choice of law doesn't take away the protection that the mandatory laws of the country where you live give you. You may bring a claim in the courts of that country or in Poland.
- Business customers: the courts competent for our address in Warsaw, Poland, decide all disputes.
21. Changes to these terms
We may change these terms for a good reason: a change in the law or an authority's decision, a change in the services ViralSwap relies on (Higgsfield, Anthropic, HikerAPI, Whop, Apple or our hosting), a change in ViralSwap's features, preventing misuse, or making the terms clearer. We e-mail you about a change at least 30 days before it takes effect; changes the law requires may take effect sooner. If you don't agree, you may end your subscription from the day the change takes effect, and we refund the part of your last payment that covers the time after that day. If you keep your subscription after the change takes effect, the new terms apply.
22. Other terms
- Our agreement. These terms, the EULA and the Refund & Cancellation Policy are the whole agreement between you and us about ViralSwap.
- Transfer. We may transfer our contract with you to a business that takes over ViralSwap. We'll tell you, and it won't reduce your rights. You may not transfer your subscription without our written OK.
- If a part of these terms is invalid, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- Notices. We write to you at the e-mail address of your Whop account.
- Language. These terms are written in English.
- Saving these terms. You can save or print this page at any time.
